Michael Manton of Curalo St in Eden will serve a five-month non-parole period for an assault he said was in self defence.
While handing down his sentence, Bega Local Court Magistrate Doug Dick made a point of Manton’s special circumstances, including his institutionalisation, anger management course work and his disadvantaged background.
According to police paperwork, the victim, who Manton has known since childhood, called the 25-year-old a “dog”, before Manton became “enraged”, pushing the victim against a wall.
The victim was then seen banging a garbage bin with what appeared to be a “baseball bat” or “metal pole” yelling at Manton to leave. The victim then threw the weapon away, again asking Manton to leave.
Manton then punched the victim twice to the face, knocking him unconscious, before kicking him twice to the body while yelling at the victim to get up, before helping him to a seated position.
The following day the victim was taken to Bega District Hospital before being transferred to Canberra Hospital where he underwent surgery for two jaw fractures.
