South Imlay St, Eden is set to become a heritage conservation area (HCA) after a vote was carried by council for the proposal; it follows public consultation on the proposal.

For the matter to be finalised council will need to submit a planning proposal and supporting information to the Department of Planning, Industry and Environment requesting a Gateway Determination under Section 3.34 of the Environmental Planning and Assessment Act 1979.
There were 30 submissions following exhibition of the plan and of those 25 were in favour of the HCA.
Council said that South Imlay St is "recognised as a significant European heritage precinct with unique heritage character that is visually prominent when viewed from the Snug Cove area of the Port of Eden, an area of high tourist visitation".
Within the HCA there are eight heritage listed properties including the the Eden Killer Whale Museum, Eden Police Station, Eden Courthouse, the former Courthouse, and the Crown and Anchor Inn. They are surrounded by 27 properties which form the HCA.
Inclusion of HCAs in Local Environment Plans (LEPs) not only acknowledges their importance, but also provides council with the opportunity to control future development in those precincts.
The provisions covering the HCA include ensuring existing heritage buildings are retained and ensuring any alterations and additions of heritage buildings, which can be seen from the street, be carried out in a manner that is in keeping with the building's historic character.
Set back and roof form are both covered in the provisions and the need for new buildings or additions to be responsive to the topography of the site.
The motion for the HCA was carried with Crs Fitzpatrick, Griff, Seckold and Allen voting in favour and Cr Nadin voting against. Crs Bain and Dodds were absent.
