It appears from Denise Dion's article on the Cattle Bay Marina – Eden Resort Hotel (Magnet, 5/12), that one of the directors of the project may have tired of their PR guy's inability to sell fake news on the project and has decided to do a Trump and have a crack himself.

He failed.
Clearly the developer is champing at the bit to start (after 18 years of nothing).
Despite not having found an "equity partner" to fund the project, not having a wave attenuator or any likelihood of ever having one, despite not having a Crown Land's lease for the water area required for a marina and having no easement from council across the non-rehabilitated foreshore to access the falling down jetty they are supposed to be maintaining, the only thing holding them back is our pesky council.
On that little issue of the foreshore reserve, Mr de Roxas stated: “The rehabilitation of the foreshore is part and parcel of our development but we never agreed to do it earlier and all of a sudden it popped up in our conditions.”
This issue didn't just "pop up".
On August 25, 2009 the Cattle Bay Resort Hotel developer dedicated Lot 4 DP 1138056 of the area covered by the Cattle Bay plan (ie the foreshore reserve strip on which stood the derelict cannery buildings) to the council, with a requirement in the masterplan for ERH to maintain and remediate the site.
An oversight (?) by Planning NSW in the subsequently amended masterplan did not include a clear clause requiring ERH to do this work.
Clearly someone in the bastions of council was concerned with the enormous financial burden the ratepayer could now be saddled with, for at the council meeting of July 22, 2015 council resolved “to execute a suitable Deed of Agreement with Eden Resort Hotel, as owners of Lot 2 DP 1138056, which identifies their obligation to demolish existing structures and rehabilitate the foreshore land dedicated to council by subdivision, being Lot 4 DP 1138056.”
The deed of agreement was never executed. ERH have to date refused to enter into a deed. Here in lies their problem. Good on our council for standing up for our community against this non-performing developer.

MVIC fundraiser
At the fundraiser to help underwrite the development of a new Visitor Information Centre in Merimbula, hosted by the Merimbula and Pambula Chambers of Commerce and Merimbula Tourism, councillor Mitchell Nadin said tourism is “everyone’s business” (MNW, 11/12).
The state government’s $25,000 contribution, together with $25,000 from ratepayers via Bega Valley Shire Council, $22,000 from the members of Merimbula Tourism, a promised contribution of $20,000 towards the fit-out from Robert Green, together with the $5000 from the fundraiser will all but provide the $100,000 total estimated cost of the fit-out. Cr Nadin is right and congratulations are in order to all concerned.

Celebrating year
The University of the Third Age Sapphire Coast (U3ASC) celebrated the end of another great year of learning and laughing together at its Christmas party at Pambula Town Hall. Around 120 members crammed into the hall for a delicious lunch catered by Cheeky Mango and an afternoon of entertainment provided by U3A members.
President Fleur Dwyer thanked all of the many volunteers who make U3ASC possible, and especially the wonderful course leaders who provide more than 900 hours of fun, friendly and low cost learning experiences for around 530 U3A members every term.
We at U3A SC wish everyone in the Bega Valley Shire a safe and happy Christmas and New Year, and we hope to see some of you as new members, enjoying what U3A has to offer, in 2019.
