Director of Eden Cattle Bay Marina Pty Ltd and Eden Resort Hotel Pty Ltd, Henri Ruiz de Roxas has confirmed that the development application for Eden’s Cattle Bay Marina will be re-submitted after lapsing in June this year.

The consent for the development was originally issued by the Southern Joint Regional Planning Panel (JRPP) on a deferred commencement basis.
The DA had a condition to remediate a section of the foreshore within a specified time frame which was not met and council advised the developer that the the consent expired on June 1, 2018.
However Mr de Roxas said the DA would be re-submitted “by the end of this month”.
“Council has told us they will support us as much as they can. We had all the approvals previously and so it shouldn’t be a problem,” he said.
Planner for the company Andrew Wilson said the DA would be re-lodged with council but “anticipated that it would progress swiftly because it had been dealt with before”.
Mr Wilson said that two matters required further work, one was the remediation of the foreshore and the other a proposed easement over the foreshore for access.
“As part of the development, when it is finished the foreshore has to be rehabilitated but council wants it done now. We’re at a bit of a loss to understand council’s additional remediation works now and we’ve asked for clarification,” Mr Wilson said.
He said that Mr de Roxas “gifted the foreshore back to council” but has since been asked to buy a 7m wide strip of land to provide legal access. Council has shared the cost of getting a valuation on the strip of land which Mr de Roxas gave to council and is now having to buy back, Mr Wilson said.
Mr de Roxas said that the company was “taking to a number of people who want to partner with us” both from Australia and overseas.
The site was listed with Knight Frank and distributed through the Asian markets earlier this year.
Mr de Roxas, who said he had been working on the project for 18 years, has written to council.
“The re-habilitation of the foreshore is part and parcel of our development but we never agreed to do it earlier and all of a sudden it popped up in our conditions.”
He said he didn’t know whether the company would have to pay the full costs of the DA submission again or not.
“The sooner this is done, the sooner everyone will benefit,” he said.
The company says the marina is the first stage of a resort precinct comprising the Eden Resort Hotel, restaurant, residential development, serviced apartments, retirement living and wellbeing centre.
