On September 26, 2017, 40-year-old Howard Brian Switzer was driving on Albert Terrace in Eden when he was stopped by police for a random breath test at 7.50am.
His test returned a negative result for alcohol, but a saliva sample was positive for cannabis.
In Eden Local Court on February 7, Switzer pleaded guilty to the charge of driving with an illicit drug present. He was convicted and fined $800 and given a six-month driving suspension.
In April 2016, Switzer was fined $400 and disqualified from driving for three month for a similar offence. In that same year, Switzer was issued a habitual offenders warning for multiple driving offences dating back to 2012.
Also in Eden Local Court last week, Daniel Richard Wicks was found guilty of driving while disqualified in another second offence matter.
Police alleged they saw the 40-year-old driving at 5.10pm on October 1 on Banks St in Eden and followed him home.
Wicks had his licence suspended for six months in June 2017 over a drug driving matter.
However, on the driving while disqualified charge, Wicks entered a plea of not guilty when he appeared in court on December 6.
Wicks’ brother Shane, who said he was visiting family at the time of the incident, submitted a statutory declaration claiming that he was the driver of the vehicle, not Daniel.
Despite the declaration, Daniel Wicks was convicted, disqualified from driving for another 12 months and placed on a 12 month good behaviour bond.
